IVRCC Advocacy Update: Attorney General Bonta Issues Workplace Guidance Regarding Employees with Temporary Protected Status

The Imperial Valley Regional Chamber of Commerce is committed to keeping our members informed of developments that may impact California businesses, employers and their workforce.


California Attorney General Rob Bonta recently issued guidance for California employers and workers regarding workplace protections and legal obligations involving employees with Temporary Protected Status (TPS). The guidance follows recent changes and ongoing legal proceedings involving federal TPS designations for several countries.


According to the Attorney General’s Office, changes to TPS designations do not change an employer’s obligations under applicable federal and California employment laws. The guidance reminds employers to follow current employment verification requirements, including Form I-9 procedures, and to verify current TPS and work authorization expiration information through appropriate federal resources.


The guidance also notes that some TPS-based Employment Authorization Documents may remain valid beyond the expiration date printed on the document due to federal notices, court orders or applicable regulations. Employers are reminded to follow proper reverification procedures, allow employees to choose which acceptable Form I-9 documents they present, and comply with applicable anti-discrimination and anti-retaliation protections. 


California employers are encouraged to review the complete guidance and stay informed about current federal employment authorization requirements.
